研究證書及標誌使用指引

目的

本指引旨在規範委託香港醫護市場調查及策劃有限公司(下稱「醫護策劃」)之企業/機構(下稱「客戶」)正確使用這些標誌及證書,確保其合法、準確且合乎規範地使用,並維護研究的公信力。

「研究」是指包括但不限於問卷調查、市場調查、滿意度測試、健康篩查等由醫護策劃獲得之數據。

證書與標誌介紹

  • 研究結果證書
    是正式書面證明,記錄研究數據和結果(包括相關研究的數據及報告),可用於展示會、客戶洽談、產品推廣等場景。
  • 研究結果標誌
    由醫護策劃頒發,是產品已完成研究的證明,標誌的內容均取自研究結果證書,可用於相關產品的宣傳材料,例如:產品包裝、海報等。

證書與標誌的使用原則

  • 證書與標誌的使用期
    除了另有明文協議,標誌的使用期限為18個月,由頒發日起計。如客戶在期限完結後仍想繼續使用證書與標誌,客戶需在到期日前的至少1個月,以書面形式向醫護策劃申請續期。
  • 證書與標誌的擁有權及使用
    證書與標誌的所有權利,包括知識產權屬於醫護策劃;醫護策劃對標誌的批准、使用、展示等均擁有最終控制權。標誌是代表醫護策劃產品或服務研究的視覺辨別標誌。標誌適用於有關研究之官方場合,並批准計劃的獲准客戶使用。醫護策劃對本規則擁有最終解釋權,並可隨時修改有關條文而不會事先通知;並有權對違反本細則者採取適當的紀律行動。
  • 結果聲明
    所有產品相關的問卷及實測研究結果均基於醫護人員所提供的真實數據,醫護策劃不對產品的任何特定效果或結果作出擔保。
  • 標誌應用形式
    標誌由標準圖形及標準色構成。標誌之圖樣及標準色、標誌的尺吋、及位置不可更改。II. 客戶使用標誌時,必須展示全個完整的標誌︰標誌的所有部份,包括其年度、文字、及設計皆不能分割。 貴客戶使用標誌時,可因應宣傳活動及物品按比例縮小或放大標誌,惟必須按照既定的比例進行縮放,不能將標誌扭曲,亦不得更改標誌的設計與字體,且標誌的高度原則上不應小於8毫米。 貴客戶須按照標誌的使用式樣使用標誌。III. 標誌可與獲批准的申請客戶的詳細資料一併使用,例如生產商、出口商及品牌之名稱或商標等。有關資料須盡可能靠近標誌。IV. 標誌在使用時應確保體面、清晰、牢固、易於識別。
  • 標誌的使用式樣
    使用式樣內的標誌均為展示樣本,內容會根據產品或服務的研究結果有所改變,標誌必須按照醫護策劃提供的設計格式展示,不得自行更改。使用標誌時,必須保持其完整性,不得遮蔽或更改。客戶應在標誌旁附加說明,清楚表明產品的實測結果。

  • 正確使用標誌的原則
    標誌的使用僅限於已通過醫護策劃研究的目標產品(或服務)。使用應與結果直接相關,不能誤導消費者。

    II. 使用研究標誌時,必須同時刊登獲授權使用標誌的客戶名稱、簡稱或標誌,在未經醫護策劃事先書面同意下,客戶不可單獨以分行/分公司/關聯公司名稱、其他營業名稱及/或品牌之名義使用標誌。III. 使用研究標誌於各類廣告或宣傳品(包括客戶網頁、商品/服務/客戶廣告等)之內容必須是合法、健康、意識良好、誠實及真確,並且不含誹謗、歧視或侮辱他人的成分。IV. 在公開使用研究標誌前,獲授權使用標誌的客戶須以電郵方式,將使用標誌的廣告或宣傳品樣本,遞交至醫護策劃作審核及存檔。該廣告或宣傳品通過審核後,方能公開使用。醫護策劃可在審核過程中,要求客戶修改及/或刪除任何展示研究標誌之形式。審核期將不少於五個工作天,敬請預留時間作修改。
  • 處理及移除過期研究證書、標誌、物品
    所有過期的證書及標誌均不可張貼及使用。II. 所有申請公司必須在其商業網站、流動應用程式及相關社交媒體平台(如適用)移除失效的電子標誌。III. 如申請公司未能根據以上方法處理及移除相關過期標貼失效的標貼、座咭及電子標誌,其來年度之申請將不獲受理,而主辦機構亦保留追究權利。

審查、處罰與終止

  • 監督檢查
    醫護策劃保留對標誌和證書使用情況進行檢查的權利,包括對產品包裝、宣傳材料和網站的審查。客戶須填妥「產品審查申請表」及通過有關程序後方能進行有關研究。否則本司有權不接受有關委託。所有有關產品之研究,醫護策劃可全權決定獲授權使用標誌的客戶有否違反本規則並可隨時要求客戶終止或修改標誌的使用。醫護策劃對本規則的條款有最終的解釋權。如有任何爭議,醫護策劃有最終及具有約束力的決定權。如發現審查時所遞交的資料有遺留、錯誤、誤導,本司有權終止有關委託及保留追究責任。不論研究是否已開始執行或已發出報告。
  • 濫用處罰
    若於標誌使用期限內,獲授權使用標誌的客戶被投訴有違反本指引的情況或被發現不當使用(包括逾期使用),醫護策劃將邀請客戶的管理層或相關人士接受調查及協助尋求解決問題的辦法。若情況未能改善,醫護策劃有權暫停或撤銷客戶的標誌和證書使用權,並保留進一步追究的權利。其他與本指引內容無關的投訴,醫護策劃將不會進行處理或進行調解。如有任何爭議,醫護策劃擁有最終及具有約束力的決定權。濫用可能導致客戶承擔相應的法律責任。
  • 放棄使用權
    客戶可根據業務需求,選擇暫時或永久放棄使用標誌或證書。客戶需提前向醫護策劃提交書面通知。
  • 終止使用
    醫護策劃可全權決定獲授權使用標誌的客戶有否違反本指引並可隨時要求客戶終止或修改標誌的使用。醫護策劃對本規則的條款有最終的解釋權。如有任何爭議,醫護策劃有最終及具有約束力的決定權。

保密與法規遵守

  • 保密義務
    客戶需對醫護策劃提供的研究內容及細節保密,不得將有關研究的內容洩露給未經授權的第三方。僅可在醫護策劃允許範圍內公開證書和標誌。
  • 個人資料處理
    客戶不得要求醫護策劃提供參加者的個人資料,進行研究時所收集的個人資料只會作為醫護策劃內部記錄用,除非得到當事人明確及自願給予的同意,否則其個人資料不會轉交予客戶。
  • 法規遵守
    如研究的產品或服務違反香港相關的條例而被法定機構及/或政府機關裁定須承擔責任,醫護策劃將保留取消該客戶使用標誌的權利。 客戶於展示標誌時,只表示該客戶的產品或服務完成醫護策劃的相關研究,而並不代表客戶的產品或服務已經被醫護策劃認可為已符合若干產品或服務的規定、標準及資格。

Research Certificate and Logo Usage Guidelines

Purpose

This guideline aims to regulate the correct use of these logos and certificates by enterprises/institutions (hereinafter referred to as “clients”) commissioned by Hong Kong Healthcare Market Research and Planning Company Limited (hereinafter referred to as “Healthcare Planning”). It ensures their legal, accurate, and compliant usage while maintaining the credibility of the research.

“Research” refers to data obtained by Healthcare Planning, including but not limited to surveys, market research, satisfaction tests, health screenings, etc.

Introduction to Certificates and Logos

  • Research Results Certificate
    A formal written proof that records research data and results (including relevant research data and reports), which can be used in exhibitions, client negotiations, product promotions, and other scenarios.
  • Research Results Logo
    Issued by Healthcare Planning, it serves as proof that the product has completed research. The content of the logo is derived from the research results certificate and can be used in promotional materials for related products, such as product packaging, posters, etc.

Principles of Use for Certificates and Logos

  • Usage Period of Certificates and Logos
    Unless otherwise agreed, the usage period for the logo is 18 months from the date of issuance. If the client wishes to continue using the certificate and logo after the expiration, they must apply for a renewal in writing at least one month before the expiration date.
  • Ownership and Usage of Certificates and Logos
    All rights, including intellectual property rights, to the certificates and logos belong to Healthcare Planning. Healthcare Planning retains final control over the approval, usage, and display of the logos. The logo serves as a visual identifier representing the research of Healthcare Planning’s products or services. It is applicable in official contexts related to the research, and only approved clients are permitted to use it. Healthcare Planning has the final interpretative authority over these rules and may amend the relevant provisions without prior notice; it also reserves the right to take appropriate disciplinary action against violators of these guidelines.
  • Results Statement
    All product-related survey and empirical research results are based on genuine data provided by healthcare personnel. Healthcare Planning does not guarantee any specific effects or results of the products.
  • Forms of Logo Application
    I. The logo consists of standard graphics and colors. The design, dimensions, and positioning of the logo cannot be altered.
    II. Clients must display the complete logo, including its year, text, and design, without any segmentation. Clients may proportionally scale the logo for promotional activities or items but must do so according to established ratios, avoiding distortion and changes to design or font. The logo’s height should not be less than 8 millimeters. Clients must use the logo according to the specified format.
    III. The logo may be used alongside the details of the approved client, such as the manufacturer, exporter, and brand names or trademarks. Relevant information should be placed as close to the logo as possible.
    IV. The logo must be used in a manner that ensures it is presentable, clear, firm, and easily recognizable.
  • Correct Principles for Logo Usage
    I. The logo’s use is limited to target products (or services) that have passed Healthcare Planning’s research. Usage must be directly related to the results and must not mislead consumers.
    II. When using the research logo, the authorized client’s name or abbreviated name must also be displayed. Clients may not use the logo under the names of branches, subsidiaries, or affiliated companies without prior written consent from Healthcare Planning.
    III. Content using the research logo in advertisements or promotional materials (including client websites, product/service/client advertisements, etc.) must be legal, healthy, ethically sound, honest, and accurate, without any defamatory, discriminatory, or insulting elements.
    IV. Before publicly using the research logo, the authorized client must submit samples of advertisements or promotional materials featuring the logo to Healthcare Planning for review and archiving via email. The advertisement or promotional material can only be publicly used after passing the review. Healthcare Planning may request modifications and/or deletions of any displays of the research logo during the review process. The review period will be no less than five working days, so please allow time for modifications.

Handling and Removal of Expired Research Certificates and Logos

  1. All expired certificates and logos must not be displayed or used.
    II. All applicant companies must remove expired electronic logos from their commercial websites, mobile applications, and related social media platforms (if applicable).
    III. If an applicant company fails to properly handle and remove expired logos, stickers, and electronic logos as outlined, their applications for the following year will not be accepted, and the organizing body reserves the right to take further action.

Review, Penalties, and Termination

  • Supervision and Inspection
    Healthcare Planning reserves the right to inspect the usage of logos and certificates, including reviewing product packaging, promotional materials, and websites. Clients must complete a “Product Review Application Form” and pass the relevant procedures before conducting related research. Otherwise, the company has the right to refuse the commission.

Healthcare Planning can fully decide whether authorized clients using the logo have violated these rules and may request clients to terminate or modify the use of logos at any time. Healthcare Planning has final interpretative authority over the terms of these rules. In case of any disputes, Healthcare Planning has the final and binding decision.

If discrepancies, errors, or misleading information are found in the submitted materials during the review, the company has the right to terminate the commission and retain liability, regardless of whether the research has commenced or reports have been issued.

  • Abuse Penalties
    If, during the usage period of the logo, an authorized client is complained about or found to have misused the logo (including overdue usage), Healthcare Planning will invite the client’s management or relevant personnel to undergo an investigation and assist in seeking solutions. If the issue is not resolved, Healthcare Planning has the right to suspend or revoke the client’s rights to use the logo and certificate, retaining the right to pursue further action. Complaints unrelated to the contents of these guidelines will not be addressed or mediated by Healthcare Planning. In case of any disputes, Healthcare Planning has the final and binding decision. Abuse may lead to the client bearing corresponding legal responsibilities.
  • Waiving Usage Rights
    Clients may choose to temporarily or permanently waive their use of the logo or certificate based on business needs. Clients must submit a written notice to Healthcare Planning in advance.
  • Termination of Use
    Healthcare Planning can fully decide whether authorized clients using the logo have violated these guidelines and may request clients to terminate or modify the use of the logo at any time. Healthcare Planning has final interpretative authority over the terms of these rules. In case of any disputes, Healthcare Planning has the final and binding decision.

Confidentiality and Legal Compliance

  • Confidentiality Obligations
    Clients must keep confidential the research content and details provided by Healthcare Planning and must not disclose any related research content to unauthorized third parties. Disclosure of certificates and logos is only permitted within the scope allowed by Healthcare Planning.
  • Personal Data Handling
    Clients must not request personal data of participants from Healthcare Planning. Personal data collected during the research will only be used for internal records by Healthcare Planning, and will not be transferred to clients unless explicit and voluntary consent is obtained from the individuals involved.
  • Legal Compliance
    If the products or services related to the research violate relevant Hong Kong regulations and are deemed liable by statutory bodies and/or government agencies, Healthcare Planning reserves the right to cancel the client’s usage of the logo. The display of the logo only indicates that the client’s product or service has completed the relevant research conducted by Healthcare Planning and does not represent that the client’s product or service has been recognized by Healthcare Planning as meeting any specific regulations, standards, or qualifications.
